SERVICE AND USAGE AGREEMENT

This Service and Usage Agreement ("Agreement") is entered into between Imperial Hosting ("Provider," "we," "us," or "our") and the customer ("Client," "you," or "your"). By using our services, you agree to comply with the terms outlined in this Agreement.
1.1 Hosting Services – We provide game server hosting, virtual private servers (VPS), dedicated servers, and other related services. 1.2 Support – We offer technical support for server-related issues but do not provide coding, scripting, or third-party software assistance unless explicitly stated. 1.3 Service Availability – We strive to maintain a 99.9% uptime but do not guarantee uninterrupted service due to maintenance, upgrades, or unforeseen technical issues.
2.1 Registration – You must provide accurate and complete information when signing up for our services. 2.2 Security – You are responsible for maintaining the confidentiality of your account credentials. Any unauthorized activity under your account is your responsibility. 2.3 Account Termination – We reserve the right to terminate accounts that violate our policies.
3.1 Prohibited Activities – You agree not to use our services for:
Illegal activities, including but not limited to fraud, hacking, or distributing malware.
Hosting offensive, hateful, or discriminatory content.
Excessive resource consumption that impacts server performance. 3.2 Resource Abuse – Excessive CPU, RAM, or bandwidth usage that negatively impacts other clients may result in service limitations or termination. 3.3 Third-Party Software – You are responsible for ensuring all software installed on your server complies with licensing agreements.
4.1 Pricing – All pricing is listed on our website and is subject to change. 4.2 Billing Cycle – Payments are due at the start of each billing cycle. Services will be suspended if payment is not received within 48 hours of the due date. 4.3 Refunds – Refunds are only issued at our discretion and are typically not available for services that have already been rendered. 4.4 Chargebacks – Initiating a chargeback will result in immediate account suspension and possible legal action.
5.1 Voluntary Termination – You may terminate your service at any time by providing written notice. 5.2 Involuntary Termination – We reserve the right to terminate your service without prior notice if you violate our terms. 5.3 Data Responsibility – You are responsible for backing up your data before termination. We are not liable for lost data upon account closure.
6.1 No Warranty – Our services are provided "as is" without any warranties, express or implied. 6.2 Limitation of Liability – We are not responsible for any damages, including data loss, downtime, or lost revenue resulting from service disruptions. 6.3 Indemnification – You agree to indemnify and hold us harmless from any claims or damages resulting from your use of our services.
7.1 Changes – We may update this Agreement at any time. Continued use of our services constitutes acceptance of the modified terms. 7.2 Notification – We will notify users of significant changes via email or website announcements.
This Agreement shall be governed by and construed in accordance with the laws of Arizona. Any disputes shall be resolved in the courts of Arizona.
